I, hereby acknowledge and agree to the following terms and conditions in consideration for being permitted to
participate in the Winter Challenge Tas event (hereinafter referred to as 'the Event').
Note that the Hill Climb Challenge (17th August) and the Multi-Sport Challenge (18th August) are both events considered under the term “the Event”. By signing this one waiver, you agree to the following terms and conditions as they refer to both the Hill Climb Challenge and the Multi-Sport Challenge:
1. Assumption of Risk: I understand and acknowledge that participating in the Event involves inherent risks, including but not
limited to physical exertion, adverse weather conditions, varying terrain, and potential for injury. I voluntarily assume all risks
associated with my participation in the Event, including those that may arise from the negligence or carelessness of the organisers,
volunteers, or other participants. I recognise that this event is held during a seasonal period of the year when Tasmania is prone to
receiving cold, windy and wet weather.
2. Medical Condition: I certify that I am physically fit and have sufficiently trained to participate in the Event. I acknowledge that it
is my responsibility to consult with a physician or other healthcare provider prior to participating if I have any concerns about my
physical condition or ability to safely participate.
3. Release of Liability: In consideration of being permitted to participate in the Event, I hereby release, waive, discharge, and
covenant not to sue the organisers, sponsors, volunteers, or any affiliated individuals or entities involved in the Event from any and
all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury,
including death, that may be sustained by me or any property belonging to me, whether caused by the negligence of the releasees
or otherwise.
4. Indemnification: I agree to indemnify and hold harmless the organisers, sponsors, volunteers, Police, first aid officers, Life
Saving officials/guards, medical and paramedical practitioners, or any affiliated individuals or entities involved in the Event
(collectively known as the “Released Entities”), from any and all claims, actions, damages, liabilities, losses, costs and expenses for
death, injury, loss of damage or property, in any way arising out of my participation and actions in the event including, without
limitation, any and all claims resulting from the negligence of the Released Entities.
5. Media Release: I consent to the use of my name, likeness, voice,and/or appearance in any photographs, recordings, or other media
captured during the Event for promotional, marketing, or other related purposes without compensation or notification. If I do not
wish to have my name, face or voice featured in any media content during the Event, I will contact the Event organisers and discuss
this with them directly.
6. Compliance with Rules and Regulations: I agree to abide by all rules, regulations, and instructions provided by the organisers and
officials of the Event. This includes, but is not limited to, following all course directions, obeying Australian road rules, and treating all
participants, volunteers, organisers and spectators with respect and common courtesy.
7. If I am involved in the Kayak Challenge or the Kayak leg of the Event, I agree to wear an Australian approved personal floatation
device (PFD) that is of good working order, for the entire duration of my time on the water. I also understand that a leg leash connecting
myself to my kayak is strongly recommended, particularly in the event of poor weather.
8. If I am involved in the Hill Climb Challenge, the Road Bike Leg or Mountain Bike Leg of the Multi-Sport Challenge, I agree that my
bike is of safe working order with two properly operating brakes. If I have any concerns about the condition of my bike/bikes in the lead
up to the event, I understand it is recommended I have the bike professionally serviced, or checked over, by a qualified bicycle mechanic.
9. If I am involved in the Hill Climb Challenge, the Road Bike Leg or Mountain Bike Leg of the Multi-Sport Challenge, I agree that I will
wear a certified Australian Standard helmet approved to the AS/NZS 2063:2008 standard. I agree that my helmet is free of defects, and
fits my head appropriately.
10.Acknowledgment of Understanding: I acknowledge that I have read this waiver and fully understand its terms. I voluntarily agree to be
bound by its provisions and enter into this agreement freely and voluntarily without any inducement, assurance, or guarantee being
made to me. I understand that these conditions may change at any time, and I will read them again prior to participating on the day(s)
of the event.
By clicking the AGREE button below, I acknowledge that I have read and understand this waiver and release of liability and voluntarily agree to its terms. If participant is under 18 years of age, I agree that a Parent/ Guardian has read this waiver and is willing to agree to the terms and conditions within this waiver on behalf of the participant.
